Terms of Service
Effective date: October 28, 2026
Please read carefully. These Terms contain a binding individual arbitration agreement, a class action waiver and a jury trial waiver (Section 19). They limit how disputes are resolved and limit our liability (Sections 16–17). You may opt out of arbitration within 30 days as explained in Section 19.8.
1. Agreement to these Terms
These Terms of Service (“Terms”) are a legally binding agreement between you and 999Precious Inc (“999 Precious,” “we,” “us” or “our”) and govern your access to and use of our website, quote form, phone, text, WhatsApp and email communications, and any related services (together, the “Services”). By using the Services, submitting a quote request, or checking the consent box on our form, you confirm that you have read, understood and agree to these Terms and to our Privacy Policy, which is incorporated into these Terms. If you do not agree, do not use the Services.
2. What we do — and what we don’t
- 999 Precious helps people who want to sell pre-owned watches. We review the information you submit and may (a) make you an offer to buy the watch ourselves, and/or (b) share your request with one or more independent third-party buyers in our network, such as watch dealers, jewelers and pawnbrokers (“Partner Buyers”), who may contact you with their own offers.
- We are not your agent, broker, appraiser, auctioneer, fiduciary, financial adviser or legal adviser, and no such relationship is created by your use of the Services. Any estimate or valuation we provide is for informational purposes only and is not a certified appraisal.
- We do not guarantee that you will receive any offer, any particular price, or any response within a particular time. References to receiving an offer “within 24 hours” describe our goal, not a guarantee.
- We may decline, pause or stop handling any request, at any time, for any reason or no reason, without liability.
3. Eligibility
You must be at least 18 years old, legally able to enter into contracts, and located in the United States to use the Services. By using the Services you represent that you meet these requirements. The Services are not intended for businesses acting as dealers unless we agree otherwise in writing.
4. Your submissions and representations
When you submit a request, upload photos, or offer a watch for sale, you represent and warrant that:
- all information you provide is true, accurate, current and complete, and you will promptly update it if it changes;
- you are the sole lawful owner of the watch, or are fully authorized in writing by the owner to sell it, and you have the right to transfer clear title;
- the watch is genuine, and is not stolen, lost, counterfeit, replica, “franken” (assembled from non-original parts) or altered in a way you have not disclosed;
- the watch is free of any lien, security interest, pledge, loan, claim or dispute;
- you will disclose all known defects, repairs, replaced or aftermarket parts, polishing and service history;
- photos you upload are of the actual watch you are offering, and you own or have the right to share them;
- the phone number and email you provide are your own, and you will tell us if you stop using them;
- you are not acting on behalf of anyone else without disclosing it, and are not using the Services for any unlawful purpose.
You are responsible for any loss, liability or expense we or our Partner Buyers suffer because any of these statements is untrue.
5. Quotes and offers
- Any quote, estimate or offer given before the watch is physically inspected is preliminary and non-binding. It is based solely on the information and photos you provide and on market conditions at that time.
- A final price is subject to physical inspection, authentication, testing and verification of the watch, its movement, parts, condition, accessories, box and papers, and of your identity and ownership. The final price may be lower than any earlier estimate, or no offer may be made.
- Offers expire after the time stated in the offer, or after 3 business days if no time is stated, and may be withdrawn before acceptance. Market prices for watches change frequently and we are not responsible for changes in value.
- No sale is final until a written or electronic bill of sale or purchase confirmation is signed or accepted and payment is made. Either party may decline to complete a sale before that point.
- Payment method, timing and any fees will be stated in the purchase confirmation. Payment may be delayed until authentication and identity checks are completed and any payment has cleared.
6. Partner Buyers
Partner Buyers are independent businesses. They are not our employees, agents, joint venturers or partners in any legal sense. If you deal with a Partner Buyer, any offer, sale, payment, shipping, inspection or other arrangement is solely between you and that Partner Buyer and is governed by their terms and policies. 999 Precious does not control, endorse or guarantee Partner Buyers, their offers, their payment, their conduct or their handling of your watch or information, and to the fullest extent permitted by law you release 999 Precious from any claims arising out of your dealings with any Partner Buyer. We recommend that you review any Partner Buyer’s terms before transacting.
7. Shipping, in-person meetings and risk of loss
- Mail-in: if a mail-in transaction is offered, you must follow the packing, shipping and insurance instructions provided. Unless the purchase confirmation says otherwise in writing, title and risk of loss stay with you until the watch is received and accepted by the buyer. We are not responsible for carrier loss, delay or damage, or for items shipped without our instructions.
- In person: any in-person meeting is voluntary and at your own risk. Meet only at the location confirmed by the buyer, preferably a business location, and never share personal security information. 999 Precious is not responsible for the conduct of anyone you meet or for any injury, loss or damage arising from a meeting.
- We are not responsible for watches, documents or accessories left with us or sent to us that we did not agree in writing to receive.
8. Authentication, stolen and counterfeit items
Every watch may be inspected and authenticated before any purchase. We and our Partner Buyers may refuse any item for any reason. If a watch is found or reasonably suspected to be stolen, counterfeit or otherwise unlawful, we may refuse it, retain it where the law requires or permits, report it to law enforcement, the manufacturer or theft registries, and share your information with them. You will not be compensated for any item that is counterfeit or that we are required to surrender.
9. Identity verification and fraud prevention
To comply with second-hand dealer, pawn, anti-money-laundering and similar laws, and to prevent fraud, we and our Partner Buyers may require government-issued photo ID, proof of ownership, proof of address, a thumbprint or other information, and may keep records and report transactions as required by law. We may refuse or cancel any transaction if verification is not completed to our satisfaction.
10. Communications, calls and text messages
- By submitting a request and checking the consent box, you give your express written consent for 999Precious Inc and its Partner Buyers to contact you about your watch at the phone number and email you provide, by phone calls, text messages (SMS/MMS) and WhatsApp messages — including calls and messages made with automated technology, an autodialer, or artificial or prerecorded voice — and by email. Consent is not a condition of any purchase or sale.
- Message frequency varies. Message and data rates may apply. Reply STOP to any text to opt out of further texts and HELP for help. You may also revoke consent at any time by any reasonable means, including by emailing sellmywatches@999precious.com. Revoking consent with us does not revoke consent you gave directly to a Partner Buyer; contact them separately.
- Mobile carriers are not liable for delayed or undelivered messages.
- Calls with us may be monitored and recorded for quality, training and record-keeping purposes. By continuing a call you consent to recording.
- You agree to receive notices, agreements, disclosures and other communications from us electronically, and that electronic communications satisfy any legal requirement that they be in writing.
- If the phone number you gave us is reassigned or you stop using it, you agree to tell us promptly. You agree to indemnify us for claims arising from calls or messages to a number you provided that you were not authorized to use.
11. License to your content
You keep ownership of photos, descriptions and other content you submit (“Your Content”). You grant 999 Precious a non-exclusive, worldwide, royalty-free, transferable and sublicensable license to use, copy, store, modify and share Your Content in order to evaluate your watch, share your request with Partner Buyers, provide and improve the Services, prevent fraud and comply with law. We will not use photos showing your face or personal documents in our advertising without your separate permission.
12. Acceptable use
You agree not to: submit false, misleading or fraudulent requests or information; offer stolen, counterfeit or unlawful items; impersonate anyone; use the Services to harass anyone; scrape, copy or collect data from the Services; use bots or automated means to submit forms; interfere with, disrupt or attempt to gain unauthorized access to the Services; or use the Services in violation of any law. We may block or terminate access and report violations to authorities.
13. Intellectual property and trademarks
The Services, including the 999 Precious name, logo, design, text and graphics, are owned by or licensed to 999Precious Inc and protected by intellectual property laws. You may not use them without our written permission.
999 Precious is an independent buyer and is not affiliated with, authorized by, endorsed by or sponsored by Rolex, Patek Philippe, Audemars Piguet, Richard Mille, Cartier, Omega, Vacheron Constantin or any other watch manufacturer. All brand names, model names and trademarks are the property of their respective owners and are used only to identify the watches we buy. Images on the Services may be illustrative and may not show the exact watch referenced.
14. Third-party services and links
The Services may link to or rely on third-party websites and services (such as WhatsApp, social networks, payment providers and carriers). We are not responsible for their content, policies or practices, and your use of them is at your own risk and subject to their terms.
15. Disclaimers
THE SERVICES, AND ALL INFORMATION, ESTIMATES AND CONTENT PROVIDED THROUGH THEM, ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY OR THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE. WE DO NOT WARRANT ANY VALUATION, PRICE, MARKET DATA OR OUTCOME. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THESE EXCLUSIONS MAY NOT APPLY TO YOU.
16. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW: (A) 999PRECIOUS INC AND ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, SUCCESSORS AND ASSIGNS (THE “999 PRECIOUS PARTIES”) WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, VALUE, OPPORTUNITY, DATA OR GOODWILL, ARISING OUT OF OR RELATED TO THE SERVICES, ANY ESTIMATE OR OFFER, ANY PARTNER BUYER, ANY MEETING OR SHIPMENT, OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES; AND (B) THE TOTAL LIABILITY OF THE 999 PRECIOUS PARTIES FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (US $100) OR THE AMOUNT 999PRECIOUS INC ITSELF PAID YOU FOR A WATCH IN THE TRANSACTION GIVING RISE TO THE CLAIM. THESE LIMITATIONS APPLY TO ALL THEORIES OF LIABILITY, INCLUDING CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY AND STATUTE, AND EVEN IF A LIMITED REMEDY FAILS OF ITS ESSENTIAL PURPOSE. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS, SO THEY MAY NOT FULLY APPLY TO YOU.
17. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify and hold harmless the 999 Precious Parties and our Partner Buyers from and against any claims, liabilities, damages, losses, penalties, costs and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Services; (b) Your Content; (c) any watch you offer or sell, including claims that it is stolen, counterfeit, encumbered or misdescribed; (d) your breach of these Terms or of any law; or (e) calls or messages to a phone number you provided that you were not authorized to use.
18. Time limit to bring claims
To the fullest extent permitted by law, any claim arising out of or related to the Services or these Terms must be filed within one (1) year after the claim arose, or it is permanently barred.
19. Dispute resolution — binding arbitration and class action waiver
19.1 Informal resolution first. Before starting any arbitration or court proceeding, you and we each agree to send the other a written notice describing the claim and the relief sought (to us at sellmywatches@999precious.com, with the subject “Notice of Dispute”; to you at the contact details you provided) and to negotiate in good faith for at least 60 days, including an individual telephone or video conference if requested. Any limitation period is paused during this time.
19.2 Agreement to arbitrate. If the dispute is not resolved, you and 999Precious Inc agree that any dispute, claim or controversy arising out of or relating to the Services, these Terms, the Privacy Policy, any communications (including any calls or text messages and any claim under the Telephone Consumer Protection Act or similar laws), any estimate, offer or transaction, or the relationship between us — whether based on contract, tort, statute, fraud, misrepresentation or any other legal theory, and whether it arose before or after you agreed to these Terms — will be resolved by final and binding individual arbitration, not in court. The arbitrator, and not any court, decides all questions of arbitrability, scope, enforceability and formation, except as stated in Sections 19.5 and 19.7.
19.3 Rules and location. The arbitration will be administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules then in effect (available at adr.org), as modified by these Terms, before a single arbitrator. The Federal Arbitration Act governs this Section 19. The arbitration may be conducted by video, phone or written submissions; any in-person hearing will take place in the county where you reside or another mutually agreed location. Fees are paid as provided by the AAA rules; the arbitrator may award fees and costs as allowed by law and the AAA rules.
19.4 Exceptions. Either party may (a) bring an individual claim in small claims court if it qualifies and stays there, and (b) seek injunctive or other equitable relief in court to protect its intellectual property rights or to stop unauthorized use of the Services.
19.5 Class action and jury trial waiver. YOU AND 999PRECIOUS INC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, REPRESENTATIVE OR PRIVATE ATTORNEY GENERAL PROCEEDING. The arbitrator may award relief only to the individual party seeking it and only to the extent needed for that party’s individual claim. YOU AND WE EACH WAIVE THE RIGHT TO A TRIAL BY JURY. If this class action waiver is found unenforceable as to any claim, that claim (and only that claim) must be severed and decided in court, after all arbitrable claims are decided, and the rest of Section 19 still applies.
19.6 Mass arbitration. If 25 or more similar demands for arbitration are filed against us by or with the help of the same or coordinated counsel, they will be administered in batches of no more than 25 demands, with only one batch proceeding at a time, and the AAA’s Mass Arbitration Supplementary Rules will apply where available. The limitation period for demands in later batches is paused until their batch begins.
19.7 Changes. If we make a material change to this Section 19, you may reject it by emailing us within 30 days of the change; your rejection keeps the previous version in force for you.
19.8 Your right to opt out. You may opt out of this arbitration agreement by emailing sellmywatches@999precious.com with the subject “Arbitration Opt-Out” and your name, phone number and email within 30 days after you first agree to these Terms. Opting out does not affect any other part of these Terms.
19.9 Courts. For any dispute not subject to arbitration, you and we agree to the exclusive jurisdiction and venue of the state and federal courts located in Sheridan County, Wyoming, and waive any objection to those courts.
20. Governing law
These Terms are governed by the Federal Arbitration Act and, to the extent not preempted, the laws of the State of Wyoming, without regard to conflict-of-law rules. Nothing in these Terms limits any non-waivable rights you have under the consumer protection laws of the state where you live.
21. General terms
- Changes. We may change these Terms at any time by posting the updated version with a new effective date. Changes apply from posting (except as stated in Section 19.7). Continued use of the Services means you accept the changes.
- Suspension and termination. We may suspend or end your access to the Services at any time, without notice, for any reason.
- Force majeure. We are not liable for delay or failure caused by events beyond our reasonable control, including carrier delays, natural disasters, pandemics, strikes, power or internet outages, cyber-attacks and acts of government.
- Assignment. You may not assign these Terms without our written consent. We may assign them without restriction, including in connection with a merger, acquisition or sale of assets.
- Severability. If any provision is held invalid or unenforceable, it will be enforced to the maximum extent permissible and the rest of these Terms will remain in effect (subject to Section 19.5).
- No waiver. Our failure to enforce any provision is not a waiver of it.
- Entire agreement. These Terms, the Privacy Policy and any written purchase confirmation are the entire agreement between you and us about the Services. If a signed purchase confirmation conflicts with these Terms, the purchase confirmation controls for that transaction only.
- Survival. Sections 4–6, 8 and 10–21 survive any termination of these Terms or of your use of the Services.
- Interpretation. Headings are for convenience only. “Including” means “including without limitation.” The English version of these Terms controls.
